StaySpark respects intellectual property rights. This policy outlines how we handle copyright infringement claims for content published on StaySpark-generated websites.


1. Our Role

StaySpark is a platform that hosts websites created by short-term rental hosts. Hosts upload their own content (photos, descriptions, guidebook entries). We do not review every piece of content before it's published, but we respond promptly to valid copyright complaints.

2. Filing a DMCA Takedown Notice

If you believe content on a StaySpark-generated website infringes your copyright, send a written notice to our designated DMCA agent with the following:

  1. Your contact information — Name, address, phone number, and email
  2. Identification of the copyrighted work — Describe the work you claim is infringed (or provide a URL to it)
  3. Identification of the infringing content — Provide the URL(s) on the StaySpark-generated website where the infringing content appears
  4. Statement of good faith — "I have a good faith belief that the use of the material described above is not authorized by the copyright owner, its agent, or the law."
  5. Statement of accuracy — "The information in this notice is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the copyright owner."
  6. Your signature — Physical or electronic

3. What Happens After We Receive a Notice

  1. Review — We review the notice for completeness (typically within 2 business days)
  2. Action — If valid, we remove or disable access to the allegedly infringing content
  3. Notify the host — We inform the host whose content was removed, including a copy of the complaint (with your contact info)
  4. Document — We keep a record of all DMCA actions

4. Counter-Notification

If you're a host and believe your content was removed in error, you may file a counter-notification including:

  1. Your contact information — Name, address, phone number, and email
  2. Identification of removed content — Describe what was removed and where it appeared
  3. Statement under penalty of perjury — "I swear, under penalty of perjury, that I have a good faith belief that the content was removed or disabled as a result of mistake or misidentification."
  4. Consent to jurisdiction — "I consent to the jurisdiction of the Federal District Court for the district in which my address is located (or the Western District of North Carolina if outside the US)."
  5. Your signature — Physical or electronic

Send counter-notifications to: support@stayspark.io with subject "DMCA Counter-Notification."

After a Counter-Notification

  • We forward the counter-notification to the original complainant
  • If the complainant does not file a court action within 10–14 business days, we may restore the removed content
  • If a court action is filed, the content remains down pending resolution

5. Repeat Infringers

StaySpark will terminate the accounts of hosts who are repeat copyright infringers. Our policy:

  • First valid DMCA notice: Content removed, warning issued
  • Second valid DMCA notice: Content removed, account suspended for 7 days
  • Third valid DMCA notice: Account terminated permanently

6. Misuse of DMCA Process

Filing false DMCA takedown notices is illegal and may result in liability for damages. Do not file a notice unless you genuinely believe your copyright is being infringed.
